Third Party Incident and Claims Reporting Procedures for Events Occurring PRIOR to 6/1/07

General Liability and Auto Liability

INTRODUCTION
For occurrences prior to June 1, 2007, Risk Enterprise Management Ltd. (REM) is the third party claim administrator (TPA) for the Resort Hotel Association's (RHA) Casualty Program.

Any accident or property damage involving a guest or third party may become a claim. Therefore, RHA members are expected to report ALL guest/third party injuries and property damage, and resort automobile accidents to REM as they occur.

REPORTING PROCEDURES
RHA requires all Members to report all accidents and property damage involving guests/third parties to REM, in a timely manner, as follows:

  1. Email a completed RHA/REM Claim Reporting Form to the appropriate REM office, with a copy to your broker. REM fees will apply.
  2. If you wish to report an accident as "Record Only," email a completed RHA/REM Claim Reporting Form to the appropriate REM office, with a copy to your broker. At the top of the completed form, write "For Record Only." A handling fee of $35 will be assessed by REM.
Send all legal paperwork (suit notices, Summons and Complaint, general correspondence, etc.) to the appropriate REM claim office. Include the relevant claim number. If you have not yet reported the incident, do so immediately and then forward the documentation to REM.

Incidents/Claims within member's SIR: If a Member property wishes to handle any matter within their SIR, that is the Member's prerogative; however, the reporting procedures set forth above should still be followed.

SERIOUS INJURIES

Any accident involving a serious injury to one of more persons, regardless of any consideration of liability or coverage, must be reported to REM immediately.

Call REM (7 days a week, 24 hours a day) at 1 – 800-ADJUST4 (1-800-235-8784) if one of the following catastrophic events has taken place. Identify your property as a member of RHA.
  1. Fatality
  2. Spinal cord injury - paraplegia, quadriplegia
  3. Amputation - requiring a prosthesis
  4. Brain damage affecting mentality or central nervous system - such as permanent disorientation, behavior disorder, personality change, seizures, motor deficit, inability to speak (aphasia), hemiplegia or unconsciousness (comatose)
  5. Blindness
  6. Burns - involving more than 10% of body with third degree, or 30% of body with second degree
  7. Multiple fractures - involving multiple body parts or a non-union fracture
  8. Nerve damage causing paralysis and loss of sensation in arm or hand
  9. Massive internal injuries affecting body organs;
  10. Injury to nerves at base of spinal canal or any other back injury resulting in incontinence of a bowel and/or bladder
  11. Hospitalization lasting greater than three (3) days
  12. Any other serious injury that, in your judgment, might warrant Gallagher Bassett's immediate involvement
REM FEES

REM will charge third party administrator (TPA) fees for their services. These fees will be charged once, at the time the accident is reported, and will cover claims handling costs for the life of the claim. Self Insured Retentions (SIR) are not eroded by REM's TPA fees. Other allocated loss expenses (ALE), such as legal fees, court costs, and deposition fees are in addition to the REM service fees; they are outside the SIR and do count toward satisfying the SIR. REM fees are as follows:

General liability claims $750
G/L property claims (minor) $300
Auto liability claims $900
Garagekeepers Legal $425
"For Report Only" $35

REM will bill the Member property directly for these costs on a monthly basis.
