Incident and Claim Reporting Procedures
General Liability and Auto Liability
INTRODUCTION
Risk Enterprise Management Ltd. (REM) is the third party claim administrator (TPA) for the Liability Program of Resort Hotel Association (RHA).
RHA recognizes that many Incidents occur at Member properties that may never result in a claim. To save RHA members unnecessary administrative costs, Zurich, RHA's insurance partner, has agreed that "Incidents" need not be reported to REM but can be reported directly to RHA on a quarterly basis.
We recommend that all Incidents be recorded on a Claim Reporting Form (Attachment 2 {General Liability} and Attachment 3 {Automobile Liability}) and maintained in the permanent files of the Member property for at least four years.
REPORTING PROCEDURES
RHA requires timely reporting of all Incidents or Claims (see definitions in Attachment 7) by Member properties. Members are responsible for reporting all Incidents and Claims as follows:
A. INCIDENTS
Incidents should be reported in one of the following two ways:
- On a "Summary Incident Report" form (Attachment 4). It should be sent to RHA within 30 days from the end of each quarter (with a copy to your broker) by e-mail to Incidents@ResortHotelInsurance.com. There is no fee associated with quarterly Summary Incident Reports submitted to RHA.
- On the appropriate Claim Reporting Form to your REM claims office. REM will charge a "per incident" fee of $40. Forms should be marked "For Report Only."
B. CLAIMS
- Claims must be reported on a written Claim Reporting Form, as soon as possible to the nearest REM office, with a copy to your broker. REM fees will apply.
- When served with a Summons and Complaint (S&C) from a lawsuit the S&C must be sent immediately to the appropriate REM claim office.
Special Note: Serious Injuries
Any Incident involving serious injury, regardless of any consideration of liability or coverage, must be reported in writing as soon as possible to both RHA and REM. Immediately contact the REM Call Center via (800)ADJUST4 (1-800-235-8784), if one of the following twelve (12) catastrophic events has taken place. Identify your property as a member of RHA.
- Spinal cord injury - paraplegia, quadriplegia;
- Amputations - requiring a prosthesis;
- Brain damage affecting mentality or central nervous system - such as permanent disorientation, behavior disorder, personality change, seizures, motor deficit, inability to speak (aphasia), hemiplegia or unconsciousness (comatose);
- Blindness;
- Burns - involving more than 10% of body with third degree, or 30% of body with second degree;
- Multiple fractures - involving more than one member or non-union;
- Fracture of both heel bones (fractured bilateral os calcis);
- Nerve damage causing paralysis and loss of sensation in arm or hand (brachial plexus nerve damage);
- Massive internal injuries affecting body organs;
- Injury to nerves at base of spinal canal (Cauda Equina) or any other back injury resulting in incontinence of a bowel and/or bladder;
- Fatalities;
- Any other serious injury that, in your judgment, might warrant Zurich's involvement.
C. REM FEES
REM will charge fees for their services, which are for the life of the claim. Other allocated expenses such as legal fees, court costs, and deposition fees are in addition to the REM service fees, but they do count toward satisfying the SIR. REM fees are as follows:

REM will bill the Member property directly for these costs on a monthly basis.
Summary Incident Reports to Resort Hotel Association incur no fees.
If a Member property wishes to handle any matter within their SIR, that is their prerogative. The reporting procedures set forth above should still be followed.
